CLIENT CONTACT ACKNOWLEDGEMENT

While sacramentoseniorcarelocator.com takes the utmost care in the selection of member care homes, be advised that when an individual fills out a request for information, under California law, sacramentoseniorcarelocator.com is not responsible for any decisions ultimately made regarding the home care provider. This is based on the legal principle that a corporation is not vicariously liable for the conduct of the residential care home, nor is it responsible for the direct provision of care or for monitoring the care provided by their contractors.

Care Home Subscription Agreement

SENIOR CARE OF SACRAMENTO ONLINE SUBSCRIPTION AGREEMENT

1. Subscription Services. Provider shall provide Subscriber access to the online services specified in the order form or enrollment process (the “Services”) for the subscription term specified therein. Access shall be via the internet or mobile application.
2. Subscription Fees. Subscriber shall pay the subscription fees set forth in the order form or enrollment process. Fees shall be paid in advance of the subscription term on a recurring basis until cancellation. Provider may increase fees upon notice before renewal.
3. Cancellation. Subscriber may cancel at any time effective at the end of the current subscription term. Cancellations require advance notice as specified in the order form or account management portal. There are no refunds.
4. Account Access. Subscriber shall receive login credentials to access their account and use the Services. Subscriber is responsible for maintaining confidentiality of credentials.
5. Service Availability. Provider shall use commercially reasonable efforts to provide continuous availability of the Services. However, temporary unavailability may occur due to maintenance, outages or other causes.
6. Intellectual Property. Provider retains ownership of all intellectual property in the Services. Subscriber may use content from the Services solely for their internal purposes during subscription term.
7. Disclaimers; Limitations on Liability. The services and related content are provided “as is” without warranty of any kind. Provider’s liability for damages shall not exceed the preceding month fees.
8. Termination for Breach. Provider may suspend or terminate access to the Services immediately for any material breach of this Agreement.
9. Entire Agreement. This Agreement constitutes the entire agreement between the parties and supersedes any prior or contemporaneous agreements. Provider may occasionally make changes or updates to this agreement. Subscriber will be notified by email.
10. Governing Law. This agreement shall be governed by the laws of California.
